Nuvem Creative (“we,” “us,” “our”) is operated by Mario Merdini, a sole proprietor based in Albania. These Terms and Conditions govern your use of this website (the “Site”) and your purchase of any products or services we offer through the Site (collectively, “Products and Services”), as described at the time of your order. By placing an order, you agree to these Terms.
1. Our Products and Services
We offer personalized products and services, which may be created with the assistance of AI tools and may go through a quality review before delivery. The specific Products and Services available, along with pricing, are shown on the Site at the time of order and may change or expand over time.
2. Ordering Process
You submit your order along with any content or information needed to complete it (which may include photos, text, preferences, or other materials depending on what you’re ordering). We may contact you if we need clarification or additional material to complete your order.
3. Payment
Payment is processed through PayPal at the time of order. We do not store your full payment card details; PayPal’s own privacy and security terms apply to that transaction.
4. Your Submitted Content
You confirm that you own or have the right to submit any content, photos, likenesses, or details you provide, and that submitting them to us does not infringe anyone else’s rights. You retain ownership of what you submit. By submitting content, you grant us a license to use it solely to create and deliver your order. We will not use your submitted content in our marketing or portfolio without your separate, explicit permission.
You agree not to submit content that is illegal, depicts real people without their consent, infringes third-party intellectual property, or is otherwise offensive or harmful.
5. Content Involving Children
If your order includes photos, likenesses, or personal details of a child, you confirm that you are the parent or legal guardian of that child, or have the explicit permission of their parent or guardian, to submit that content and have it used to fulfil your order.
6. AI-Assisted Creation
Some Products and Services may be created or supported with AI tools, with a quality review before delivery. Where applicable, likenesses and details in the final output are stylized interpretations, not exact reproductions, and may not perfectly match what you submitted.
7. Delivery
Finished Products and Services are delivered digitally, in the form appropriate to what you ordered (e.g., download link, hosted access, or file delivery). Access links may expire after a limited time; please save or secure access to your deliverables promptly.
8. Revisions, Cancellations, and Refunds
Because our Products and Services are custom-made for you, we generally do not offer refunds once work has started. If what you receive contains a clear error or defect relative to your order, contact us within 7 days of delivery and we’ll provide a reasonable revision or, where a revision isn’t possible, consider a partial or full refund at our discretion. Orders may be cancelled for a full refund only if work has not yet begun.
9. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of our Products and Services or the Site. Our total liability for any claim is limited to the amount you paid for the relevant order.
10. Changes to These Terms
We may update these Terms from time to time, including as we introduce new Products and Services. Continued use of the Site or future orders after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Albania, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your own country provide otherwise.
